By Rocky Mountain News Eagle District Attorney Mark Hurlbert on Tuesday announced he had filed an appeal, as expected, to the Colorado Supreme Court, challenging a judge's decision not to limit questioning of Kobe Bryant's alleged victim at a hearing later this month. At a pretrial hearing for Bryant last week, District Judge Terry Ruckriegle rejected a prosecution motion seeking to place limits on defense questioning of the 19-year-old woman. The questioning would concern whether any of her sexual conduct before or after her encounter with the Los Angeles Lakers star can be admitted at his trial. Ruckriegle had also rejected Hurlbert's request to reconsider that ruling.
Bryant's next pretrial hearing, at which Ruckriegle expects to continue hearing from witnesses on the issue of the alleged victim's sexual history and its relevance at trial, is scheduled for March 24 and 25. Copyright 2004, Rocky Mountain News. All Rights Reserved. |
